Welcome to  Mission Metals Manufacturing  (the “Website”). This Terms of Use Agreement (the “Agreement”) is made and entered into by and between you and Mission Metals Manufacturing LLC (the “Company”, “us”, “we”, or “our”). This Agreement sets forth the terms and conditions that govern your use of and access to the Website and any products, materials, and services provided by or on the Website (collectively, the “Services”).



1. Acceptance of this Agreement

By accessing or using the Services (or by clicking on “accept” or “agree” to this Agreement when prompted), you agree to be bound by the terms and conditions of this Agreement on behalf of yourself or the entity or organization that you represent. If you do not agree to the terms and conditions of this Agreement, you may not use or access the Services and must exit the Website immediately.



2. User Generated Content


This is used to send appointment confirmations and links, account information, product information, marketing messages, help requests, webchat widget responses plus opt-in and opt-out confirmations.



3. Eligibility Requirements to Use or Access the Services


To use the Website or any other Services, you must be:

  • At least 18 years old;
  • A resident of the United States, Canada, or the United Kingdom; and
  • Not a competitor of or using the Services for purposes that are competitive with the Company


By accessing or using the Services, you represent and warrant that you meet all the foregoing eligibility requirements. You also represent and warrant that you have the right, authority, and capacity to enter into this Agreement on your behalf or the entity or organization that you represent. If you do not meet all these requirements, you may not use or access the Services.

The Company reserves the right to modify, withdraw, or discontinue the Services, in whole or in part, at any time without notice to you. You agree that the Company shall have no liability to you or any third party for any losses or damages caused by the Services not being available, in whole or in part, at any time or for any period.
  • Creating an Account:  You may be required to register for an account and provide certain information about yourself to access the Services or certain features of the Services. You promise to provide us with accurate, complete, and updated information about yourself.   • Account Responsibilities:  You are entirely responsible for maintaining the confidentiality of your password and account. You are also entirely responsible for any and all activities associated with your account. You agree to notify the Company immediately of any actual or suspected unauthorized use of your account.
  • Termination or Deletion of an Account: The Company shall have the right to suspend or terminate your account at any time in our sole discretion for any or no reason, including if we determine that you have violated any terms or conditions of this Agreement.



5. Policy for Using the Services


Prohibited Uses:  You may use the Services for lawful purposes only and in accordance with this Agreement. You agree not to use the Services in any way that could damage the Services or general business of the Company. You may use the Services for any business or commercial purposes.


Prohibited Activities:

  • No Violation of Laws or Obligations: Violate any applicable laws or regulations.
  • No Unsolicited Communications:  Send any unsolicited advertising, spam, or junk mail.
  • No Impersonation: Impersonate others or misrepresent your affiliation.
  • No Harming of Minors: Exploit or harm minors in any way.
  • No Interference with Others’ Enjoyment: Harass or interfere with anyone’s use of the Services.
  • No Interference or Disabling of the Services: Use any device or software that interferes with the proper working of the Services.
  • No Monitoring or Copying Material: Use robots, spiders, or manual processes to scrape or mine data.
  • No Viruses or Damaging Software: Upload viruses, Trojan horses, or logic bombs.
  • No Reverse Engineering: Attempt to obtain the source code of the Services.



6. Geographic Restrictions


The Company is based in the United States. The Services are for use by persons located in the United States only. By choosing to access the Services from any location other than the United States, you accept full responsibility for compliance with all local laws.



7. Intellectual Property


Ownership of Intellectual Property:

You acknowledge that all intellectual property rights in the Services and its contents (the “Content”) are owned by the Company, its licensors, or other providers. Neither this Agreement nor your access to the Services transfers to you any right, title, or interest in such rights.


License to Use:

The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use and access the Content for any business or commercial use in accordance with this Agreement.




8. SMS Messaging Terms and Compliance


  • Program Description: This messaging program sends appointment confirmation and reminder messages to customers who have booked an appointment with Mission Metals Manufacturing through our website at https://www.missionmetalsmfg.com/, or via scheduling forms, or have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox for SMS consent. Messages include scheduling confirmations, appointment reminders, rescheduling updates, and customer support communications.
  • Cancellation Instructions: You can cancel the SMS service at any time. Simply text “STOP” to the same number that sent you messages. Upon sending “STOP”, we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially or send “START”, and we will resume sending SMS messages to you.
  • Support Information: If you experience issues with the messaging program, reply with the keyword “HELP” for more assistance, or reach out directly to sales@missionmetalsmfg.com or call (352) 781-4072 during business hours.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.
  • Message & Data Rates: Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.
  • Supported Carriers: Our SMS program works with all major U.S. wireless carriers including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.
  • Age Restriction: You must be 18 years old or older to participate in our SMS program.

9. User Content


You are solely responsible for your User Content. You grant to the Company an irrevocable, non-exclusive, royalty-free, perpetual, and worldwide license to reproduce, distribute, and exploit your User Content in connection with the Services and the Company’s business.


Content Standards:  User Content must not violate laws, promote illegal activity, infringe intellectual property, or contain defamatory or objectionable material.

11. Warranty Disclaimer & Limitation of Liability


THE SERVICES ARE PROVIDED ON AN “AS-IS” BASIS. USE OF THE SERVICES IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.


LIMITATION OF LIABILITY: IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES. YOUR SOLE REMEDY FOR DISSATISFACTION IS TO STOP USING THE SERVICES.



12. Disputes & Governing Law


  • Governing Law:  This Agreement is governed by the laws of the State of Florida.
  • Dispute Resolution: Any legal action shall be brought in courts located in {{location.city}}, Florida.
  • Arbitration: At the Company’s discretion, disputes may be submitted to binding arbitration in {{location.city}}, Florida.
  • Class Action Waiver:  YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.



13. Miscellaneous


  • Waiver & Severability: Failure to enforce a right does not waive it. If a provision is found unenforceable, the rest of the Agreement remains in effect.
  • Entire Agreement:  This constitutes the entire agreement between you and the Company.
  • Opt-out: You can cancel SMS services at any time by texting "STOP". For help, text "HELP" or email sales@missionmetalsmfg.com.



14. Changes to Terms


The Company reserves the right to change this Agreement from time to time in its sole discretion. Except for changes made for legal or administrative purposes, the Company will provide reasonable advance notice before the changes become effective. All changes will apply to your use of and access to the Services from the date the changes become effective and onwards. For new users, the changes will be effective immediately.


Your continued use of or access to the Services following any changes to this Agreement shall constitute your acknowledgment of such changes and agreement to be bound by the terms and conditions of such changes. You should check this page frequently so that you are aware of any changes since they are binding on you.
